The Ohio Industrial Commission will Hold a Public Hearing to Consider Rule Amendments

The Ohio Industrial Commission will hold a Public Hearing on Wednesday, July 19, 2017 at 1:00 p.m., L-2, Room 1, 30 West Spring Street, Columbus, Ohio to consider the following:

The Amendments of the following rules:

• 4121-3-18 Administrative appeals
  The proposed changes are to make Ohio Adm.Code 4121-3-18 consistent with Ohio Adm.Code 4121-3-09. Specifically, Ohio Adm.Code 4121-3-18(B)(4) provided that it was a rebuttable presumption that an order is electronically received the next commission business date after the e-mail notification was sent by the commission. In order to be consistent with Ohio Adm.Code 4121-3-09, it is proposed to change the rebuttable presumption to within three days of the date of mailing of the order, unless the day of receipt is a Saturday, Sunday, legal holiday, or a day the commission offices are closed, in which event the order will be presumed received on the next succeeding commission day of business which is not a Saturday, Sunday, legal holiday, or a day the commission offices are closed.


• 4121-15-03 Standards of conduct
  The proposed amendment would include a definition of “value” in order to better clarify the rule.

All interested parties will be given an opportunity to be heard. Any interested party unable to attend the public hearing may submit written comments via email to rulecomments@ic.ohio.gov prior to the hearing. Pursuant to the Americans with Disabilities Act, the Industrial Commission will consider a reasonable accommodation to allow qualified, interested parties with a disability to testify where the accommodation is necessary and available and does not present an undue hardship to the Industrial Commission.
