The Ohio Industrial Commission will Hold a Public Hearing to Consider Rule Amendments

The Ohio Industrial Commission will hold a Public Hearing on Friday, May 13, 2016 at 1:00 p.m., L-2, Room 1, 30 West Spring Street, Columbus, Ohio to consider the following:

The Amendments of the following rules:

  • 4121-3-16 Motions
    The amendment to the rule eliminates paragraph (E) that requires that a motion contain legal citations, where required by rule. It was determined there is not a requirement elsewhere in the rules or policies of the Industrial Commission requiring such citation; therefore, this requirement is unnecessary.

  • 4121-3-22 Inspection of claim files
    This rule establishes the persons and entities that are authorized to access and inspect a claim file. The Commission is proposing to delete the paragraph that sets out the required elements for authorizations for injured workers not containing claim numbers as this provision in the rule is no longer necessary. The Commission is also proposing the deletion of the paragraphs addressing the completion and execution of a request for inspection, inspection of a claim at a point other than where the claim is located, and when a request for inspection will be honored.

  • 4121-3-30 Emergency hearings
    This rule provides the procedures for requesting an emergency hearing and establishes the standard for granting such a request. The proposed amendment to the rule adds a requirement that the Commission contact both parties in an attempt to reach an agreement regarding the date and time of the emergency hearing.

All interested parties will be given an opportunity to be heard. Any interested party unable to attend the public hearing may submit written comments via email to rulecomments@ic.ohio.gov prior to the hearing. Pursuant to the Americans with Disabilities Act, the Industrial Commission will consider a reasonable accommodation to allow qualified, interested parties with a disability to testify where the accommodation is necessary and available and does not present an undue hardship to the Industrial Commission.
